IRS 401(k) Questionnaire and Its Impact on Future Compliance
 
Description The IRS recently sent out 1,200 Questionnaires to employers sponsoring 401(k) plans trying to determine where compliance deficiencies exist. Employers are nearing the end of the response period. Hear a practitioner perspective about what is involved in completing the questionnaire and where inadvertent issues may lurk. More importantly, the IRS intends to use what it learns from the Questionnaire as the basis of future exams.

The first 1,200 recipients may be luckier than subsequent recipients since they are not dealing with an audit. They have the ability to use the EPCRS program to correct problems they discover before the IRS shows up. Future recipients may be left to use the Closing Agreement Program, which carries stiff penalties.

Now is the time to look at the issues raised by the questionnaire and work with clients to conduct self-audits before the IRS comes knocking at the door. How would your clients have fared if they had been one of the first 1,200?
